Terms of Service

These Terms of Service ("Terms") constitute a legal agreement between you (the parent or legal guardian) and CRUISEYS COMPUTERS LLC ("CRUISEYS COMPUTERS LLC", "we", "us", or "our"). These Terms apply to all applications, games, websites, and related services ("Services") provided by CRUISEYS COMPUTERS LLC.

Your use of the Services is also governed by our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, please do not use the Services.

As our applications are directed toward children, parents and legal guardians should read these Terms and the Privacy Policy carefully.

Children use these applications with the permission of a parent or legal guardian, or

Adults use these applications on behalf of children.

This legal agreement is entered into by the children's game studio with the child's parent or guardian. By permitting your child to use the Services, you acknowledge that you accept these Terms on their behalf.

1. Service License

Subject to these Terms, CRUISEYS COMPUTERS LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

Install and use our applications on devices that you own or control;

Use the Services solely for personal, non-commercial entertainment purposes.

You may not:

Copy, distribute, or publicly display our applications or content;

Modify, reverse engineer, decompile, or attempt to extract source code;

Circumvent or interfere with security protections;

Use the Services for any unlawful, harmful, or unauthorized activities.

2. Ownership of Content

All artwork, graphics, characters, code, animations, trademarks, music, sounds, and other content within the Services are the property of CRUISEYS COMPUTERS LLC or its licensors. Use of the Services does not grant you any ownership rights.

3. In-App Purchases and Subscriptions (Apple App Store Only)

Some Services may offer optional one-time purchases and/or auto-renewing subscriptions. All purchases and subscriptions are processed by the Apple App Store. CRUISEYS COMPUTERS LLC does not process, collect, or store full payment information.

By making an in-app purchase or subscription, you agree that:

You are authorized to use the associated Apple ID and payment method;

All transactions are billed by Apple, not by CRUISEYS COMPUTERS LLC;

All refunds and billing matters are governed by Apple's policies;

CRUISEYS COMPUTERS LLC cannot issue direct refunds or modify subscription billing;

You are solely responsible for managing purchases and subscription settings through Apple.

We use the Firebase service to manage subscription status and entitlements. Firebase does not process payments; billing remains handled by Apple.

3.1. Auto-Renewal

If you select a subscription, your subscription may auto-renew. Apple will charge your Apple ID unless you cancel at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription at any time through your Apple ID settings (e.g., Settings > [Your Name] > Subscriptions). Deleting the app does not cancel your subscription.

Parents and guardians are solely responsible for managing or canceling subscriptions through their device or Apple account.

4. Advertising

Some applications may display advertisements.

Advertisements are contextually relevant only;

We do not serve any behavioral or personalized advertisements;

We do not support cross-app or cross-site tracking;

We do not identify children;

All advertising SDKs operate in a COPPA-restricted "Child Safe Mode".

5. Prohibited Conduct

You agree not to:

Interfere with or disrupt the Services;

Introduce viruses or harmful code;

Attempt to gain unauthorized access to servers, accounts, or data;

Use bots or automated tools;

Use the Services for any illegal or harmful activities.

6. Updates and Changes to the Services

We may update, modify, or terminate any part of the Services at any time, including adding or removing features, improving performance, releasing necessary updates, or discontinuing support.

7. Disclaimer

To the maximum extent permitted by law, the Services are provided "as is" and "as available". We make no express or implied warranties regarding the Services' functionality, availability, reliability, or operation without errors or interruptions.

8. Limitation of Liability (Capped at Amount Paid)

8.1. No Indirect Damages

CRUISEYS COMPUTERS LLC, its owners, affiliates, and employees are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including data loss, loss of profits, or device-related issues.

8.2. Total Liability Cap – Amount Paid

If any liability is found to exist and cannot be excluded, CRUISEYS COMPUTERS LLC's maximum total compensation for any claim related to the Services is limited to the total amount you paid for the specific application and its in-app purchases in the twelve (12) months preceding the claim. If you have not paid anything, our liability is $0.

8.3. Consumer Law Exceptions

Some jurisdictions do not allow certain exclusions. In such cases, this section applies only to the extent permitted by law.

9. Parental Responsibility

Parents and guardians agree they are responsible for:

Supervising their child's use of the Services;

Ensuring a safe and appropriate device environment;

Reviewing the Privacy Policy and understanding parental rights;

Managing Apple parental controls and subscription settings.

10. Privacy

Your use of the Services is governed by our Privacy Policy, which explains:

What information we collect (and do not collect);

How we use information;

How children's privacy is protected;

Parents' rights and how to exercise them.

11. Third-Party Services and Platforms

The Services may rely on third-party platforms or tools, including:

Apple App Store

Advertising SDKs

Crash reporting or analytics tools

These services are governed by their respective terms and privacy policies. CRUISEYS COMPUTERS LLC is not responsible for the actions of third parties outside its control.

12. Termination

We may suspend or terminate your access to the Services at any time, including for:

Legal or Apple policy compliance;

Your violation of these Terms;

Our discontinuation of a Service.
